Terms of service

Agreement

These Terms govern access to epure.sh and Epure Cloud operated under the trade name Epure.

By using the website, joining the waitlist, or creating a Cloud account, you agree to these Terms and the Privacy Policy.

If you do not agree, do not use the services. Questions: legal@news.epure.sh.

Self-hosted software

The open-source Epure binary and related code are licensed under Apache License 2.0 (https://github.com/epure-sh/epure/blob/main/LICENSE).

These Terms do not replace that license. Running your own instance is your responsibility: security, backups, compliance, and data you ingest.

Accounts and eligibility

  • You must be able to form a binding contract and use the service for lawful professional purposes.
  • You are responsible for credentials, DSN keys, and activity under your account.
  • We may refuse, suspend, or terminate access for abuse, non-payment, legal risk, or operational necessity.
  • One natural person operates the service; there is no obligation to provide phone support or a physical meeting.

Plans, quotas, and billing

Cloud plans, prices, and event quotas are described on the pricing page and may change prospectively.

Unless stated otherwise, fees are prepaid, non-refundable except where mandatory law requires otherwise, and exclude taxes you owe.

Soft-sampling and spike controls may limit stored payloads while still counting volume, as described in product materials. That is not a SLA credit mechanism.

We may change or discontinue features with reasonable notice when practicable.

Acceptable use

  • Do not probe, attack, or overload the service except under a coordinated disclosure agreed with us.
  • Do not send unlawful, harmful, or infringing content, or data you are not allowed to process.
  • Do not resell Cloud access or circumvent plan limits without written permission.
  • Do not use Cloud to process data that requires certifications we do not claim (for example HIPAA).

Your data

You retain rights to data you submit. You grant us a limited license to host, process, and display that data solely to provide and secure the service.

You represent that you have a lawful basis to send us personal data contained in error events and account information.

On account closure we delete or anonymize service data within a reasonable period, except records we must keep by law.

Our intellectual property

Epure marks, site content, and Cloud software (excluding your data and Apache-licensed self-host code) remain the Operator’s or its licensors’ property.

No license is granted except the limited right to use Cloud as offered.

Disclaimer of warranties

THE WEBSITE AND CLOUD SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted or error-free operation, or that stored events will meet your compliance needs.

Nothing in these Terms excludes liability that cannot be excluded under mandatory French or EU law.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE OR CLOUD IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) FEES YOU PAID FOR CLOUD IN THAT PERIOD OR (B) FIFTY EUROS (€50).

Self-hosted use is entirely at your own risk under the Apache 2.0 license terms.

Indemnity

You will defend and indemnify the Operator against claims arising from your data, your use of the service, or your breach of these Terms, to the extent permitted by law.

Privacy

Personal data is handled as described in the Privacy Policy at /legal/privacy.

Governing law and disputes

These Terms are governed by the laws of France.

Courts: the competent courts of Paris, France, subject to mandatory consumer protections that cannot be waived.

If you qualify as a consumer under applicable law, mandatory protections still apply.

Miscellaneous

  • If a clause is unenforceable, the rest remains in force.
  • These Terms are the entire agreement for Cloud and the website, superseding prior terms on the same subject.
  • We may assign the agreement to a successor operating Epure; you may not assign without our consent.
  • Failure to enforce a provision is not a waiver.
